Ethical and Legal Issues

As a leader, one has legal and ethical responsibility. Both nonprofits and public organizations have ethical and legal practices that need to be managed. Many unethical issues in these institutions continue to plague the industry leading to fraud and financial abuse. This paper analyzes the various legal and ethical problems and the how to address them. The first legal issues are enormous salaries and perks. The staffs of these organizations earn exorbitant salaries even though most of them are underfunded (Corey et al., 2014). Also, accountability has been a problem for these groups. These issues will be addressed by coming up with policies that control the actions of the institution’s leaders. Another ethical concern of these organizations is fraud and tax evasion. Lack of transparency and negligence has been an ethical concern for quite some time. This can be eliminated by recruiting competent leaders that will hold the office with great disciple and ideals. Also, conducting regular auditing in the different departments will reduce these issues (Corey et al., 2014).

These organizations have legal concerns that affect their operations. The first concern is political campaigns and lobbying. They usually do this to solicit funds for their activities. As a leader, I would lay strict rules, and penalties for institutions that engage in political campaigns. The second issue is that many organizations do not comply with taxation. Regular tax audit should be carried out to ensure every organization pays their taxes (Corey et al., 2014). Thirdly, the nonprofit organizations are best known for misusing the interns and volunteers without pay. The labor agencies should do thorough investigations and give penalties to organizations that overwork interns. Another common legal concern is about disgruntled employees. Many organizations would terminate employees without any legal guidelines. This goes against the right of the staffs and the employment acts. Employees should be encouraged to go to court in such cases (Corey et al., 2014).

The news is plagued with controversies surrounding large businesses over their ethical and/or legal issues. Manufacturing companies are usually seen in the forefront of these controversies. As a manufacturer the company is responsible for proper advertising, maintaining a safe and ethical manufacturing environment, for reducing harm to the environment, for operating a fair and secure workplace and to provide safe products (HG.org 2018)

In 2016, members of congress realized that manufacturers whom were making meatless meat and dairy less “milk” were labeling the packages with the word’s “milk” or “meat”. The Cattleman’s Association stated that the false labeling took away from their actual meat and milk industry. As a result congress petitioned the Food and Drug Administration to end what they referred to as “illegal misrepresentation of plant-based beverages” and in 2018 the US Cattleman’s Industry filed a similar petition asking the US Department of Agriculture to ban the use of “meat” labels unless the product came from a living animal (Scottie A. & Morrow A., 2019). This has drawn large law suits on the basis of ethical marketing in manufacturing along with law suits that fight first amendment freedom to “market as thy please”.

The approaches that I might take to address these issues as a manager or leader within the meatless or milk less manufacturing industry would be to create a culture of fairness within the manufacturing world. If organizations want to build a culture that encourages ethical conduct and a commitment to compliance, the research shows that they should focus on two types of fairness; outcome fairness and procedural fairness (Tyler, T. et al 2008).
